Terms of Service

1. Service Description

SDS Generator ("the Service") is an automated tool that assists users in generating Safety Data Sheets (SDS) for research compounds. The Service compiles information from publicly available chemical databases (including PubChem, ECHA, and ChemSpider) and, where authoritative data is unavailable, supplements certain sections with AI-assisted analysis.

The Service is a tool that assists the user — it does not replace professional chemical safety assessment. Generated SDS documents are starting points that require review and verification by a qualified person before use.

2. User Responsibility

Under OSHA's Hazard Communication Standard (29 CFR 1910.1200), the chemical manufacturer or importer is the legally responsible party for the accuracy of a Safety Data Sheet — even when a third-party service prepares the document. By using this Service, you acknowledge and agree that:

  • You are solely responsible for verifying the accuracy and completeness of all information in any SDS generated through the Service.
  • You will have all generated SDS documents reviewed by a qualified person before distribution or use.
  • You are responsible for compliance with all applicable federal, state, and local regulations regarding chemical safety documentation.
  • You will not rely on the Service as the sole source of chemical safety information for any substance.

3. AI-Assisted Content

When authoritative databases do not contain sufficient information for certain SDS sections (typically Sections 7, 8, 11, and 12), the Service may use AI-assisted analysis to generate draft content for those sections. AI-generated content is:

  • Clearly identified with source badges in the editing interface.
  • Disclosed in Section 16 of the generated SDS document, specifying which sections were AI-assisted.
  • Based on the AI model's training data and, where available, web searches of authoritative sources (OSHA, NIOSH, CDC, EPA, PubChem).
  • Not a substitute for laboratory testing, toxicological assessment, or professional classification.

The Service does not use AI to generate or modify GHS hazard classifications (H-codes, signal words, or pictograms) — these are sourced exclusively from authoritative databases or deterministically derived from validated hazard codes.

4. Research Use Only

The Service is designed for generating SDS documents for research-use compounds. Generated documents include a "research use only" designation. The Service is not intended for and must not be used for:

  • Pharmaceutical manufacturing or drug production
  • Food safety or agricultural applications
  • Consumer products intended for household use
  • Any application requiring certified or independently validated SDS documents

5. Disclaimer of Warranties

THE SERVICE AND ALL GENERATED DOCUMENTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

The Service compiles data from third-party sources and has not independently tested any substance described in generated documents. We do not warrant that the information in any generated SDS is complete, accurate, current, or suitable for any particular purpose.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SDS GENERATOR, ITS OPERATORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Service;
  • Any inaccuracy, incompleteness, or error in any generated SDS document;
  • Any action taken or decision made in reliance on information provided by the Service;
  • Any personal injury, property damage, or other harm resulting from use of a generated SDS.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

7. Indemnification

You agree to indemnify, defend, and hold harmless SDS Generator and its operators, affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service or any generated SDS document;
  • Your failure to verify or review generated information;
  • Your violation of these Terms or any applicable law or regulation;
  • Any third-party claim arising from your distribution or use of a generated SDS.

8. Data and Privacy

We store generated SDS documents and associated compound data to provide the Service. You may request deletion of your data by contacting us. We do not sell personal information to third parties.

9. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
